Welcome to DigiPlog. These Terms of Service ("Terms") govern your access to and use of the DigiPlog digital pilot logbook service, including our website and applications (collectively, the "Service").
By creating an account or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
2. Description of Service
DigiPlog provides a digital logbook platform for pilots to:
- Record and manage flight logs electronically
- Track licence and medical certificate expiry dates
- Calculate flight statistics including night flying hours
- Visualise flight history on interactive maps
- Store aircraft and passenger information
- Access flight records across multiple devices
3. Account Registration
To use certain features of the Service, you must create an account. When registering, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorised access
You must be at least 16 years old to create an account and use the Service.
4. User Responsibilities
As a user of DigiPlog, you are responsible for:
- Data Accuracy: Ensuring all flight data you enter is accurate and complete. DigiPlog does not verify the accuracy of your entries.
- Regulatory Compliance: Understanding and complying with all applicable aviation regulations regarding logbook requirements in your jurisdiction.
- Backup: Maintaining your own backup copies of critical flight data where required by regulations.
- Acceptable Use: Using the Service only for lawful purposes and in accordance with these Terms.
5. Digital Logbook Disclaimer
Important: While DigiPlog is designed to be CAA-aligned and suitable for maintaining pilot flight records:
- DigiPlog is a tool to assist you in maintaining your flight records
- You remain solely responsible for compliance with all regulatory requirements
- Acceptance of digital logbooks may vary by authority and examiner
- We recommend checking with your relevant aviation authority regarding digital logbook acceptance
- Some authorities may require physical signatures or paper records for certain purposes
6. Intellectual Property
The Service and its original content, features, and functionality are owned by DigiPlog and are protected by international copyright, trademark, and other intellectual property laws.
You retain ownership of all flight data and personal information you submit to the Service. By using the Service, you grant us a limited licence to store, process, and display your data solely to provide the Service to you.
7. Prohibited Activities
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorised access to the Service or other accounts
- Interfere with or disrupt the Service or servers
- Transmit viruses, malware, or other harmful code
- Scrape, copy, or harvest data from the Service without permission
- Impersonate another person or entity
- Use the Service to create false or fraudulent flight records
- Share your account credentials with others
8. Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will endeavour to provide advance notice of scheduled maintenance where possible.
9. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" without warranties of any kind
- We do not warrant that the Service will be error-free or uninterrupted
- We are not liable for any indirect, incidental, special, or consequential damages
- Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
- We are not responsible for regulatory decisions or consequences related to your use of digital logbooks
10. Indemnification
You agree to indemnify and hold harmless DigiPlog and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.
11. Termination
You may terminate your account at any time by contacting us or using the account deletion feature. We may suspend or terminate your access to the Service:
- If you breach these Terms
- If required by law
- If we discontinue the Service (with reasonable notice)
Upon termination, you may request export of your flight data within 30 days.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
